<p class="wp-block-paragraph">Starting October 1, 2026, Florida’s new license plate frame law makes clear that a license plate frame or decorative border is not a crime, as long as it doesn’t cover the parts of the plate that matter. The change comes from Senate Bill 488, which added subsection (2) to&nbsp;<a href="http://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&URL=0300-0399/0320/Sections/0320.061.html">section 320.061, Florida Statutes</a>.</p>



<h2 id="h-why-the-change-was-needed" class="wp-block-heading">Why the Change Was Needed</h2>



<p class="wp-block-paragraph">Under section 320.061, it is a second-degree misdemeanor to knowingly alter a license plate, or to put any material on or around a plate that interferes with its legibility, visibility, or detectability. The law also covers anything that interferes with the ability to record the plate, such as by toll or traffic cameras. The statute was broad enough that drivers with ordinary dealer frames or decorative borders worried about being stopped or charged.</p>



<h2 id="h-what-florida-s-new-license-plate-frame-law-says" class="wp-block-heading">What Florida’s New License Plate Frame Law Says</h2>



<p class="wp-block-paragraph">A license plate frame or decorative border is not an offense under section 320.061, as long as it does not obscure:</p>



<ul class="wp-block-list">
<li>the license plate number, or</li>



<li>the registration decal or validation sticker in the upper right corner of the plate.</li>
</ul>



<h2 id="h-what-is-still-illegal" class="wp-block-heading">What Is Still Illegal</h2>



<ul class="wp-block-list">
<li>Tinted, smoked, or reflective plate covers.</li>



<li>Sprays, coatings, or anything else that makes the plate harder to read or record.</li>



<li>Illuminated devices on or around the plate.</li>



<li>Any frame that blocks the plate number or the registration sticker.</li>
</ul>



<h2 id="h-what-this-means-for-drivers" class="wp-block-heading">What This Means for Drivers</h2>



<p class="wp-block-paragraph">A frame that leaves the plate number and sticker fully visible is legal. A frame that cuts off part of a number or hides the sticker is not, and it can still lead to a criminal charge. The statute applies only to knowing violations, so the facts of each stop matter. This change appears to favor drivers and should help reduce bogus stops from happening concerning license plate issues.</p>

<p class="wp-block-paragraph">Florida’s license plate law 2025 significantly strengthens penalties for altering or obscuring license plates, effective October 1, 2025. Under this law, drivers who cover, modify, or tamper with their plates using sprays, tinted covers, wraps, or any device that makes the plate difficult to read can now face criminal charges.</p>



<h2 id="h-how-penalties-have-changed-under-florida-s-license-plate-law-2025" class="wp-block-heading">How Penalties Have Changed Under Florida’s License Plate Law 2025</h2>



<p class="wp-block-paragraph">Courts once treated this violation as a minor traffic infraction. Now Florida classifies it as a <a href="http://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&URL=0300-0399/0316/Sections/0316.605.html">second-degree misdemeanor</a>. If a driver alters or obscures a license plate while committing a crime or fleeing from law enforcement, the charge can escalate to a third-degree felony. This carries substantial penalties, including potential jail or prison time.</p>



<p class="wp-block-paragraph">Florida’s license plate law 2025 also targets suppliers. It makes it a first-degree misdemeanor to manufacture, sell, or distribute devices designed to hide or alter license plates. These changes reflect Florida’s effort to curb evasive driving tactics and strengthen law enforcement’s ability to identify vehicles involved in criminal activity.</p>

This memo helps drivers and law enforcement better understand what the law actually prohibits.</p>



<h2 id="h-what-flhsmv-clarified-about-florida-s-new-license-plate-law" class="wp-block-heading">What FLHSMV Clarified About Florida’s New License Plate Law</h2>



<p class="wp-block-paragraph">FLHSMV states that&nbsp;license plate frames&nbsp;are allowed as long&nbsp;as they do not&nbsp;obscure the&nbsp;alphanumeric&nbsp;characters on the&nbsp;plate or the&nbsp;validation decal in&nbsp;the top right corner.&nbsp;The department&nbsp;clarified that it&nbsp;does not consider the&nbsp;text along the bottom&nbsp;of the plate to be a&nbsp;primary identifying&nbsp;feature. As a result,&nbsp;frames that cover&nbsp;slogans or county&nbsp;names at the bottom&nbsp;of the plate are&nbsp;generally&nbsp;permissible.</p>



<p class="wp-block-paragraph">The&nbsp;statute targets&nbsp;“license plate&nbsp;obscuring devices”&nbsp;that hide the plate,&nbsp;interfere with the&nbsp;legibility or&nbsp;detectability of&nbsp;critical identifying&nbsp;features, or prevent&nbsp;cameras or officers&nbsp;from recording the&nbsp;plate number or&nbsp;validation sticker.&nbsp;This includes items&nbsp;such as anti-camera&nbsp;covers, sprays,&nbsp;wraps, or other&nbsp;devices designed to&nbsp;defeat visibility.</p>



<h2 id="h-penalties-and-enforcement" class="wp-block-heading">Penalties and Enforcement</h2>



<p class="wp-block-paragraph">Violations&nbsp;of the law can carry&nbsp;serious consequences,&nbsp;ranging from a&nbsp;second-degree&nbsp;misdemeanor to a&nbsp;third-degree felony&nbsp;in more severe&nbsp;circumstances.&nbsp;However, many law&nbsp;enforcement agencies&nbsp;have indicated they&nbsp;intend to issue&nbsp;warnings for&nbsp;unintentional&nbsp;violations while&nbsp;educating drivers&nbsp;about compliance.</p>
