The Tim Burke case has taken another turn. Federal prosecutors announced they will pursue a new indictment against the Tampa media consultant, seeking charges that avoid the free speech problems that sank half of the original case.

A New Indictment on the Way

Assistant U.S. Attorney Jay Trezevant told the court the government will ask a grand jury for revised charges designed to cure the defects in the original indictment. The move comes just days after prosecutors dropped their appeal of a ruling by U.S. District Judge Kathryn Kimball Mizelle, who dismissed seven of the fourteen original charges against Burke on First Amendment grounds.

At a hearing this week, Mizelle gave prosecutors 30 days to secure the new indictment and set Burke’s trial date for December 7.

The Defense Pushes Back

Burke’s attorney, Michael Maddux, objected to the government pursuing a new indictment at all. The defense maintains Burke is a journalist who accessed and published video footage using publicly available credentials, not stolen ones.

Maddux told the judge that depending on what the new indictment alleges, the defense anticipates filing new legal challenges. This could mean further pretrial litigation and a possible delay of the trial. Even so, Maddux said Burke is ready to take the case in front of a jury.

“Tim’s been under the weight of this indictment for way too long,” Maddux said. “And journalism has been held hostage way too long.”

The Legal Distinction at the Center of the Tim Burke Case

Judge Mizelle’s earlier ruling turned on a key legal distinction. The video streams Burke accessed did not meet the legal definition of a “wire communication” under the federal Wiretap Act, but may qualify as an “electronic communication” instead. This distinction matters because prosecuting an interception of electronic communications requires the government to prove additional elements, including that Burke was not a party to the communication and that the footage was not transmitted through a system readily accessible to the public.

Prosecutors will need to build any new indictment around that framework.

What’s Next

The trial remains scheduled for December and could run as long as two weeks, though both the judge and prosecutors acknowledged further pretrial motions could push that date back again.
