Florida’s 2-Year Injury Claim Deadline: Don’t Wait

Reviewed by Michael P. Maddux, Esq. | Board Certified Criminal Trial Lawyer | Florida Super Lawyer for 16 Consecutive Years
Florida law gives injured individuals a limited window to file a personal injury lawsuit. In most cases, that deadline is now two years from the date of the accident, a significant reduction from the previous four-year limit that changed in 2023.
While two years may sound like plenty of time, delays can seriously damage a case. Evidence can be lost, surveillance footage erased, witnesses become difficult to locate, and insurance companies may use the passage of time to deny or minimize claims. Most importantly, missing the deadline means permanently losing your right to recover compensation, no matter how strong your case may be.
Do not assume you can wait until the last minute, and do not delay simply because you are unsure whether you have a claim. A timely review of the facts and the applicable deadlines can make all the difference. Our office offers free consultations to help you understand your rights, evaluate your timeline, and take action with confidence before it’s too late.
